REACH—Compliance and Emerging Issues

REACH is a new European Community Regulation on chemicals and their safe use (EC 1907/2006) that encompasses Registration, Evaluation, Authorization and Restriction of Chemical substances.   The new law entered into force on June 1, 2007, as companies began pre-registering phase-in substances at that time.  Manufacturers and importers will be required to gather information on the properties of their chemical substances.  Read more

SFAS 141(R) Standard—Quantifying Environmental Liability

As of December 15, 2008, a new SFAS standard will increase the cost and level of effort during environmental due diligence.  SFAS 141(R) creates major changes in the accounting for M&A related transactions, and requires environmental issues be immediately quantified to better establish their impact on the value of the deal. EPA Encourages New Owners to Audit

The EPA has developed an interim policy that offers incentives, such as lower penalties, to new owners who correct environmental violations at recently-acquired regulated facilities.  Read more about the EPA’s policy for a “clean start”, where new owners have the opportunity to correct environmental problems that began under the previous owner’s watch.

Standard Practice for Assessment of Vapor Intrusion (ASTM Standard E 2066-8)

The purpose of the Standard Practice for Assessment of Vapor Intrusion into Structures on Property Involved in Real Estate Transactions (ASTM Standard E 2600-8) is to define good commercial and customary practice in the USA for conducting vapor intrusion assessment (VIA) on a property parcel involved in a real estate transaction with respect to chemicals of concern (COC) that may migrate as vapors into existing or planned structures on a property.  This practice is designed to be used in conjunction with a Practice E 1527 Phase I ESA, or it may be used independently, and is to be used as a screening evaluation to determine whether the vapor intrusion exposure pathway is complete (and a vapor intrusion condition (VIC) exists). The VIA process consists of 4 tiers, with Tier 1 as the initial step. Read More
